These terms of business set out the general terms under which our firm will provide insurance, investment and mortgages services to you and the respective duties and responsibilities of both the firm and you in relation to such services. Gary Cunnane t/a Cunnane Insurance Brokers is regulated by the Financial Regulator as a Multi-Agency Intermediary under the investment Intermediaries Act, 1995; as a Mortgage Intermediary authorised under the Consumer Credit Act, 1995 and as an Insurance Intermediary registered under the European Communities (Insurance Mediation) Regulations, 2005. OUR SERVICES |
Cunnane Insurance Brokers is an Insurance and Mortgage Broker and is a member of the Professional Insurance Brokers Association (PIBA). We hold written appointments from the product producers set out in Appendix 1 to this document. |
General Insurance |
We provide services in relation to the following non-life insurance products: motor, household, commercial, public liability, employer liability and fire. Depending on your instructions, we can give advice in relation to the products of the insurers listed in Appendix 1 and receive and transmit orders on your behalf to these insurers. We will also offer assistance in processing claims on policies taken out with us and in seeking renewal terms. |
Life and Pensions |
Life Assurance companies provide products such as life cover, serious illness cover, income protection, savings, investments and pensions. Depending on your individual circumstances, we may provide you with advice in relation to these products and which products may be suitable for your needs. (These product producers are listed in Appendix 1) |
Mortgage Business |
We act as Mortgage Brokers and we will take you through a range of mortgage options that are available on the market and ensure that you are getting the most competitive mortgage available. Cunnane Insurance Brokers are in receipt of commissions from Lenders at a rate of up to 1% of the value of the amount borrowed. (These product producers are listed in Appendix 1) |
Commission and Charges |
We are remunerated by commission from the completion of business with the product producers listed in Appendix 1. In relation to General Insurance we may charge a Broker Fee of up to €50 for the completion of new business and/or policy alterations.
In relation to Life Assurance, Investment Business or Mortgages which are placed with us, we are paid a commission on business placed with us by each provider we hold an appointment with. This payment is taken into account in the quotation provided to you and summary information is contained in the product information document. Before completion of your application it is important that you receive this information and that you understand the details contained. Full details will be included in the cooling-off letter issued by the product provider.
Instead of, or in addition to commission payments, we may charge a fee of up to €1,000 for work done. This fee will be determined by factors such as specialist skills, complexity, urgency and the amount of commission payable |
Client Monies |
We will accept payments in cash, cheque or credit card in respect of all classes of insurance in the circumstances permitted under Section 25G of the Investment Intermediaries Act 1995. Payments must represent premia in respect of either (a) a renewal of a policy which has been invited, or (b) a proposal accepted by a product provider. Any monies paid directly to Cunnane Insurance Brokers are placed in a “Client Premium Account” and transmitted to the relevant product provider. |
Receipts |
We will issue receipts for each payment received pursuant to Section 30 of the Investment Intermediaries Act 1995 and these should be retained in a safe place. A receipt will also be issued in respect of all completed Direct Debit Mandates received. |
Conflicts Of Interest |
It is our policy to avoid any conflict of interest at all times. If this is not possible we will notify you as soon as practicable and you may rest assured that you will be treated fairly where such a conflict is unavoidable. |
Complaints |
We comply with the Complaint Handling procedures as laid out by the Consumer Protection Code. All complaints are recorded and acknowledged to the complainant with a 5 working day period. Regular written updates will be provided every 20 working days at the latest. If the complaint has not been resolved within 40 days, you have the right to refer the matter to the Financial Services Ombudsman or the Pensions Ombudsman. |
Default On Payments by Clients. |
Should a customer default on a payment due to Cunnane Insurance Brokers, our legal right to pursue such payment may be exercised. Reimbursement will be sought for all payments made to insurers on behalf of clients where the firm has acted in good faith in renewing a policy of insurance for the client. A product provider may withdraw benefits on a policy where non-payment occurs. Details of such circumstances are contained in the policy terms and conditions of the product provider and issued to each client. |
Compensation Scheme |
We are members of the Investor Compensation Scheme operated by the Investor Compensation Company Ltd. |
